If you are searching for the BCBS settlement right now, you almost certainly want one of two things: your payment, or an explanation of why it has not arrived.
Here is the short version. The Blue Cross Blue Shield antitrust settlement is real, it is worth $2.67 billion, and payments to valid claimants began going out on 11 May 2026. But the deadline to file a claim was 5 November 2021, and the official settlement website lists it as passed. If you did not file then, you cannot file now, and anyone telling you otherwise, particularly anyone charging a fee, is running a scam.
If you did file, this page explains where your money is.

What the Blue Cross Blue Shield settlement is about
The case is an antitrust class action. Plaintiffs allege that the Blue Cross Blue Shield Association and the Settling Individual Blue Plans violated antitrust laws by entering into an agreement not to compete with each other, and to limit competition among themselves in selling health insurance and administrative services for health insurance.
The Settling Defendants deny all allegations of wrongdoing and assert that their conduct results in lower healthcare costs and greater access to care for their customers. As the official settlement website states, the Court has not decided who is right or wrong. The parties agreed to settle to avoid the risk and cost of further litigation.
Class Representatives reached the settlement on 16 October 2020, establishing a $2.67 billion Settlement Fund. Alongside the money, the Settling Defendants agreed to make changes in the way they do business that Plaintiffs believe will increase opportunities for competition in the health insurance market.
The two settlement classes
The Court certified two Settlement Classes:
- Damages Class, whose members could file a claim for a monetary payment
- Injunctive Relief Class, which benefits from the business practice changes rather than a payment
The full definitions are set out in FAQ 7 on the official settlement site. If you are unsure which class you fell into, that is the authoritative place to check.
Official key dates, straight from the settlement website
The administrator publishes a Key Dates page, and every deadline on it has now passed:
| Milestone | Date | Status |
|---|---|---|
| Notice commencement | Spring 2021 | Passed |
| Objection deadline (most classes) | 28 July 2021 | Passed |
| Exclusion or opt out deadline (Damages Class) | 28 July 2021 | Passed |
| Fairness hearing | 20 to 21 October 2021 | Passed |
| Claims filing deadline (Damages Class) | 5 November 2021 | Passed |
| Objection deadline (self funded entity accounts) | 2 May 2022 | Passed |
| Exclusion deadline (self funded entity accounts) | 2 May 2022 | Passed |
Note the split deadlines. Self funded entity accounts had until May 2022 to object or opt out, while everyone else had until July 2021. That distinction confuses a lot of people looking back at this case.
Why payments took until 2026
This is the question behind most of the frustration, and the answer is ordinary procedure rather than anything sinister.
The settlement was reached in October 2020. The fairness hearing was held in October 2021, and the claim deadline fell weeks later in November 2021. Then came the appellate process, which suspends distribution entirely until it concludes.
According to widely reported coverage of the court record, the district court granted final approval in August 2022, the Eleventh Circuit affirmed that approval in October 2023, and the United States Supreme Court declined to review the case in June 2024, making the settlement fully final. A distribution order followed in April 2026, with the initial distribution beginning on 11 May 2026.
Treat that procedural chronology as reported rather than official. The settlement website itself confirms the fairness hearing date and the 11 May 2026 distribution start, but does not publish the appellate timeline. If you need certainty on the court record, the PACER Case Locator indexes federal cases, though PACER charges $0.10 per page.
The practical result is a gap of more than four years between filing a claim and receiving money. Long, but not unusual for a multi billion dollar antitrust case. Our guide to how class action settlements work walks through why the sequence from claim deadline to distribution routinely takes this long.
How much is the BCBS settlement payout?
The gross fund is $2.67 billion. Attorneys’ fees and administration costs come out of that before anything reaches claimants, which is standard. See how class action payouts are calculated for why the headline figure is never the claimant pool.
The administrator has not published a per person figure, and your payment depends on the premiums you paid during the class period and which allocation option you selected when you filed.
What the reporting says
News coverage of the distribution has reported an estimated net fund of roughly $1.9 billion and a simple average payment in the region of $333 per claim. Reporting on the April 2026 distribution order also describes two payment rules: calculated payments of $5 or less are not issued, and payments of $200 or more are made at 90% in the first round, with the remaining 10% held in reserve for a possible second distribution.
Treat all of those figures as reported estimates rather than official ones. They are consistent across multiple outlets, but the settlement administrator has not published them on its own website, and an average is arithmetic rather than a promise about your check.
Your own claim determination notice is the authoritative figure for your payment. Nothing on any third party site, including this one, overrides it.
The second distribution nobody is talking about
If the reported 90% rule is accurate, claimants owed $200 or more have not yet received their full award. A second distribution of the reserved portion would follow after the initial rounds and any reissues complete.
No date has been announced for it. If you received a payment that looked slightly smaller than you expected, this is a likely explanation, and it is worth checking your claim determination notice rather than assuming an error.
How to check your BCBS settlement claim status
If you filed a valid claim, this is the single most useful thing you can do:
Go to the Check Your Claim Status page and enter your Claim Number or Unique ID.
The administrator states plainly that it is unable to provide the exact date any specific Damages Class Member’s payment will be sent. Payments are issued in waves rather than all at once, so the status tool is the closest thing to a real answer available.
Other official tools on the settlement site:
- Upload Supporting Documentation, if the administrator has requested documents from you
- Lookup Second Blue Bid Eligibility, a separate eligibility check relating to the settlement’s injunctive relief terms
- Contact the Claims Administrator
- Important Documents, including the full settlement notice
- Español, the Spanish language version of the settlement site
If you have lost your Claim Number, contact the administrator directly:
- Phone: (888) 681-1142
- Email: info@BCBSsettlement.com
- Post: Blue Cross Blue Shield Settlement, c/o JND Legal Administration, PO Box 91390, Seattle, WA 98111
How to redeem a BCBS prepaid card
Damages Class Members who requested to be paid by prepaid card receive an email from distribution@BCBSsettlement.com containing an activation code. The administrator’s own guidance states these emails were sent during the month of May.
The official redemption site is settlementpayment.choicepaymenthub.com. On that site, click “Activate My Card”, then “Enter activation code instead”, and enter the activation code from your email.
Two things to be careful about here. First, that email address and that redemption domain are the only legitimate route. Any other site asking for your activation code is a phishing attempt. Second, check your spam and promotions folders, and any older email address you may have used when filing back in 2021. Five years is a long time, and misdirected notification emails are one of the most common reasons people believe their payment never came.
Why haven’t I received my BCBS payment?
Working through the likely causes, most to least common:
Your wave has not been issued. Distribution is sequential, not simultaneous. Two claimants with similar coverage can be weeks apart purely by batch position. Not receiving payment on a particular day says nothing about whether your claim was approved.
You chose a paper check. Checks take longer than electronic payments, then longer again in the post.
Your contact details changed since 2021. A different email address, a house move, or a bounced notification will all delay things. If you have moved, contact the administrator to update your address rather than waiting.
Your claim needed extra review. Claimants who selected the Alternative Option allocation rather than the Default Option submitted supporting documentation, and those claims take longer to process.
Your payment fell below the minimum. Per reporting on the distribution order, calculated payments of $5 or less are not issued at all.
Your claim was denied. If so, you should have received a claim determination notice explaining it, with a window to dispute the premiums paid figure used in your allocation.
If your payment was returned as undeliverable, re-issuance is handled through the official settlement portal, never through an email or phone call that reaches out to you first.
Beware of BCBS settlement scams
A settlement this large, this widely publicised, and this delayed creates close to ideal conditions for fraud. The claim deadline passed nearly five years ago, so any message inviting you to file a new BCBS claim is fraudulent by definition.
Specific red flags for this settlement:
- Any request for a fee to “process”, “release” or “expedite” your payment
- Any site other than settlementpayment.choicepaymenthub.com asking for your card activation code
- Any request for your full Social Security number or bank login credentials
- Unsolicited calls claiming to be from the settlement administrator
- Look alike domains resembling bcbssettlement.com
- Any third party service offering to chase your check for a fee
The Federal Trade Commission’s standing guidance applies here: legitimate redress programs never require you to pay money or provide account information to receive a payment. If you have been targeted, report it at ReportFraud.ftc.gov. If your personal information was exposed, IdentityTheft.gov is the FTC’s recovery resource. Our guide to class action settlement scams covers verification in more detail.
Is the BCBS settlement payment taxable?
This one is genuinely debatable, and worth more care than most settlement tax questions.
The IRS test is what the payment was intended to replace. This settlement resolves an antitrust claim about allegedly inflated insurance premiums. It is not compensation for personal physical injury, so the exclusion under Internal Revenue Code Section 104 does not apply.
That leaves two competing readings. Because the payment broadly returns money you overpaid in premiums, it can look like a non taxable recovery of your own after tax money. But because it arises from an antitrust claim rather than a simple refund, and because premium payment arrangements differ enormously, the analysis is not clean.
The safer working assumption is that the payment may be taxable unless a tax professional advises otherwise, particularly if the premiums were paid pre tax through payroll deduction on an employer sponsored plan.
See the IRS guidance on tax implications of settlements and judgments and Publication 4345, which is written specifically for people receiving class action settlement checks. Our own guide on whether settlement money is taxable explains the general rules.
For a payment of any size, ask a tax professional rather than guessing.
The separate BCBS Provider Settlement
There are two distinct Blue Cross Blue Shield settlements, and people conflate them constantly.
This page covers the Subscribers Settlement: individuals and companies that purchased or received health insurance provided or administered by a Blue Cross Blue Shield company.
There is a separate Provider Settlement for healthcare providers, at bcbsprovidersettlement.com, which the official subscriber site links to directly. It is a different fund with its own claim process and its own deadlines, and its claim window has also closed. If you are a physician, clinic or hospital rather than a subscriber, that is the site you need.
What to do now
If you filed a claim: check your status at the official portal, search your old email accounts for a notification from distribution@BCBSsettlement.com, and be patient with the wave schedule. If eight or more weeks have passed since you were notified and nothing has arrived, call the administrator on the number above.
If you did not file: there is nothing to do. The deadline passed in 2021 and cannot be reopened. What you can do is avoid missing the next one. Our list of currently open class action settlements tracks live claim deadlines, and how to know if you qualify explains how to check a class definition against your own records.
Frequently Asked Questions
Can I still file a BCBS settlement claim in 2026?
No. The claim deadline was 5 November 2021 and the official settlement website lists it as passed on both its homepage and its Key Dates page. No new damages claims are being accepted. Any website, email or caller inviting you to file a BCBS claim now, especially for a fee, is not connected to the official settlement.
How much is the average BCBS settlement payment?
The administrator has not published an official per person figure. News coverage has reported an average in the region of $333, derived from an estimated net fund of about $1.9 billion, but that is arithmetic rather than an official number or a promise about your check. Your actual payment depends on the premiums you paid during the class period and the allocation option you selected. Your claim determination notice is the authoritative amount.
Why was my BCBS payment less than I expected?
Two likely explanations. First, reporting on the April 2026 distribution order indicates payments of $200 or more were issued at 90% in the first round, with 10% reserved for a possible second distribution, so a larger award may arrive in two parts. Second, allocations are pro rata by premiums paid, so the figure often differs from what people estimate from memory. Check your claim determination notice before assuming an error.
When will I get my BCBS settlement check?
Distribution began on 11 May 2026 and is being issued in waves. The administrator states directly that it cannot provide the exact date any specific class member’s payment will be sent. Electronic payments and prepaid cards generally arrive before paper checks. If you know your Claim Number or Unique ID, the official claim status page is the only reliable way to check where yours stands.
Is there a second BCBS distribution?
Reporting on the distribution order indicates a portion of larger payments was reserved for a possible second distribution after initial rounds and reissues complete. No date has been announced, and the administrator has not published details on its own site. Check bcbssettlement.com rather than relying on third party predictions.
Who was eligible for the Blue Cross Blue Shield settlement?
The Damages Class covered individuals and companies that purchased or received health insurance provided or administered by a Blue Cross Blue Shield company during the class period. Full definitions are in FAQ 7 on the official site. Eligibility alone was never enough, though. Only class members who filed a valid claim by 5 November 2021 can receive a payment.
Is the BCBS settlement legitimate or a scam?
The settlement itself is entirely legitimate. It arises from In re: Blue Cross Blue Shield Antitrust Litigation, MDL 2406, in the US District Court for the Northern District of Alabama, Master File No. 2:13-cv-20000-RDP, and is administered by JND Legal Administration at bcbssettlement.com. What is not legitimate is any message asking you to file a new claim, pay a fee, or enter your card activation code on a site other than the official redemption portal.
What if my BCBS settlement check never arrives or is returned?
Contact the claims administrator directly on (888) 681-1142 or at info@BCBSsettlement.com. Payments returned as undeliverable can be re-issued through the official settlement portal. Do not respond to any unsolicited message offering to re-issue your payment. Initiate contact yourself using the details on the official site.
Why did the Blue Cross Blue Shield settlement take so long to pay out?
The settlement was reached in October 2020 and the fairness hearing was held in October 2021, but appeals followed, and appeals halt distribution entirely until resolved. Reporting on the court record indicates final approval in 2022, an appellate affirmance in 2023, and the Supreme Court declining review in 2024, after which the administrator could complete claim allocation and fraud screening. Delays of several years are normal in antitrust settlements of this size.
