Pork Settlement: Claim Your Share of $117 Million by 29 October 2026
If you bought bacon, pork chops, or other raw pork cuts at a grocery store between 2014 and 2018, you can likely claim money from a $117 million settlement, and you do not need a receipt to do it.
Five pork processors, Clemens, Hormel, Seaboard, Triumph and Tyson, have agreed to pay a combined $117,065,000 to settle claims that they conspired to inflate pork prices for a decade. The claim window opened in late August 2026 and closes 29 October 2026.
You are not being asked to prove exactly what you bought. You are being asked to estimate it, and to attest to that estimate.

What the case is about
The lawsuit alleges that pork processors, including JBS, Clemens, Hormel, Seaboard, Smithfield, Triumph and Tyson, inflated and stabilized the price and supply of pork through the use of a data-sharing service called Agri Stats, production restraints, and export practices.
In plain terms: the claim is that instead of competing normally, these companies used shared production data to keep supply artificially tight, which kept prices higher than a genuinely competitive market would have produced.
The defendants deny all allegations of wrongdoing, and the court has not ruled that any of them did anything wrong. The parties settled to resolve the claims without a trial deciding who was right. The court granted preliminary approval on 31 July 2026.
All seven original defendants have now settled. JBS and Smithfield settled earlier, and that claim period is closed. This is a second, separate claim window covering the five remaining companies plus Agri Stats.
What Agri Stats agreed to, and why it pays nothing
Agri Stats is part of this settlement but contributes no money to the consumer fund. Instead it agreed to a detailed set of conduct reforms: no longer disclosing non-public competitor data to pork subscribers, requiring every data field in its reports to draw from at least three entities with no single entity exceeding 70% of the data, and ceasing publication of pork sales reports and pricing data not otherwise available to the public. These reforms run for five years if Agri Stats ever resumes the reports it says it has already stopped producing.
You cannot opt out of the Agri Stats settlement, even though there is no payment attached to it. You can opt out of the five cash settlements individually.
Who qualifies
Per the official settlement website, you are included if you are a person or entity who indirectly purchased raw pork bacon, or raw fresh or frozen pork made from bellies, loins, shoulder, ribs or chops, for personal consumption, between 28 June 2014 and 30 June 2018.
“Indirectly purchased” means you bought it at a grocery store or supermarket, not directly from one of the defendants.
The 24 covered jurisdictions
This is an indirect-purchaser antitrust case, which under US law can generally only proceed in states that allow indirect purchasers to sue, sometimes called Repealer Jurisdictions. The official site lists exactly 24: Arizona, California, the District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Rhode Island, South Carolina, Tennessee, Utah and West Virginia.
That is 23 states plus DC. If your purchases happened in a state not on this list, this settlement does not cover you, however much pork you bought.
What is excluded
Products: anything marketed as organic or no-antibiotics-ever, and any pork product other than bacon that is marinated, seasoned, flavored or breaded.
People and entities: the defendants themselves, their officers, directors and employees, any entity a defendant controls, government entities, the presiding judge and their staff, and any identified co-conspirator.

Why no receipts are demanded upfront
This is a large, multi-year class covering a staple grocery item nearly every household bought repeatedly. Requiring a receipt from a bacon purchase in 2016 would exclude almost everyone with a genuine claim.
Reporting on the claim process indicates no documentation is required when you initially submit a claim, and that the administrator may request additional information later to support it. That is consistent with how most large indirect-purchaser consumer settlements are structured, and it mirrors the approach covered in our guide to settlements with no proof required.
Your payment is calculated pro rata, based on the amount of eligible pork you report buying relative to everyone else who files, not a flat amount per person. The official FAQ states plainly that it is currently unknown how much any individual claimant will receive, and that the claims administrator may institute a minimum payment, though none has been confirmed. If mailing anything, do not wait until the last few days. The official FAQ warns that mail is not postmarked the day it is dropped in a mailbox, only when it reaches a postal processing facility, and recommends mailing at least a week before any deadline, or using certified mail or an in-person postmark to be certain.

Opting out or objecting
You have until 29 October 2026 to opt out of the five cash settlements, which preserves your right to sue those companies individually but forfeits any payment from this fund. Opting out must be done by mail, with your original signature. You cannot opt out by phone or email, and bulk exclusion requests filed by a third party on behalf of multiple class members are not accepted.
You cannot opt out of the Agri Stats settlement under any circumstances, since it involves no payment to release.
Objecting means telling the court in writing why you think the settlements are unfair, while remaining part of the class. Objections must be mailed to both the administrator and the court by the same deadline. The judge cannot rewrite the settlement terms in response to an objection, only approve or decline to approve them as written.
What happens if you do nothing
Per the official FAQ, doing nothing means you remain a member of the settlement class and are legally bound by the outcome once it becomes final, but you will not receive a cash payment. Filing a valid claim is the only way to be paid.
When will payments be made?
No date has been announced. The final approval hearing is 11 December 2026 at 11:00 a.m. CST, before Judge John R. Tunheim at the US District Court in Minneapolis. Attendance is optional.
Payments follow only after the court approves the settlements and any appeal period expires. Given the sequence, a realistic payment window is well into 2027. What comes out of the fund before you
Class counsel, Hagens Berman Sobol Shapiro LLP and Gustafson Gluek PLLC, will ask the court for attorneys’ fees of up to one third (33 1/3%) of the combined settlement amounts, plus up to $5,000,000 in litigation expenses, and $3,000 service awards for each of the 28 named class representatives. The court decides the final amount and may award less than requested. These class counsel represent you at no direct cost, though you may hire your own lawyer at your own expense if you prefer.

Is the payment taxable?
This is a genuine refund of an alleged overcharge, which generally points away from taxable income. You would be compensated because the price of a product you bought was allegedly inflated above what a competitive market would have charged, closer to a price adjustment than a gain.

I already filed in the JBS or Smithfield pork settlement. Do I need to file again?
Yes, if you want a share of this fund. This is a separate settlement covering five different companies, Clemens, Hormel, Seaboard, Triumph and Tyson, with its own claim form and deadline. A claim filed in the earlier JBS or Smithfield round does not carry over automatically.
Does this cover all 50 states?
No. It covers 24 jurisdictions: 23 states plus Washington, DC. Check the official site’s covered jurisdiction list before assuming your purchases qualify, since this type of indirect-purchaser antitrust claim can generally only proceed in states that permit it.
Can a business file this claim, or only individual consumers?
The settlement class includes any “person or entity” who indirectly purchased eligible pork for personal consumption, so this is not strictly limited to individual consumers. What matters is that the purchase was for personal consumption rather than resale or commercial food service use.
